Privacy Notice for California Residents

Effective Date: 10/22/26 | Last Updated: 10/22/26

This Privacy Notice for California Residents (“California Privacy Notice”) supplements the information contained in the American Collectors Insurance, LLC Privacy Policy and applies to individuals who reside in the State of California (“consumers” or “you”).

American Collectors Insurance, LLC (“American Collectors,” “ACI,” “we,” “our,” or “us”) provides this notice to describe our collection, use, disclosure, retention, and other processing of personal information and the privacy rights that may be available to California residents under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”), and other applicable California privacy laws. This notice is used to allow us to fulfill our CCPA obligations and explain your CCPA rights.

Certain personal information collected, processed, or disclosed pursuant to applicable federal or state insurance or financial privacy laws may be exempt from some requirements of the CCPA. Nothing in this notice is intended to limit rights that may be available to you under other applicable privacy or insurance laws.

Our CCPA obligations do not extend equally to all individuals because we are covered by certain explicit statutory exemptions in the CCPA. Under those exemptions, the full breadth of CCPA obligations applies to us only with respect to California residents who are visitors to, or users of, our websites and online services, who are members of our workforce or job applicants, or who communicate with us on behalf of our vendors and business partners.

“cross-context behavioral advertising” means the targeting of advertising to a consumer based on that consumer’s personal information obtained from activity across businesses or distinctly-branded websites, applications, or services, other than the business or distinctly-branded website, application, or service with which the consumer intentionally interacts. (In other words, if we send you an ad based solely on your interaction with us or our services, this is not cross-context behavioral advertising.)

“personal information” generally means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an individual or household.

“sensitive personal information” means personal information that is not publicly available and reveals one or more of the following:

  • A consumer’s Social Security, driver’s license, state identification card, or passport number;
  • A consumer’s account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account;
  • A consumer’s precise geolocation;
  • A consumer’s racial or ethnic origin, religious or philosophical beliefs, or union membership;
  • The contents of a consumer’s mail, email, and text messages unless American Collectors is the intended recipient of the communication;
  • A consumer’s genetic or biometric data; or
  • Personal information collected and analyzed concerning a consumer’s health, sex life, or sexual orientation.
  • “share,” “shared,” or “sharing” means sharing, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, personal information to a third party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration.

Depending on your relationship and interactions with American Collectors, we may collect, and within the last 12 months may have collected, the following categories of personal information. We disclosed this personal information for one or more legal or business purposes as permitted by the CCPA.

We may also disclose information in connection with a merger, acquisition, reorganization, sale of assets, financing, or similar business transaction as permitted by law.

When we disclose personal information for a business purpose, we enter into an agreement with the receiving party that describes the purpose for sharing the personal information and that requires the receiving party to keep that personal information confidential. Our service providers are obligated not to use the personal information for any purpose other than performing the services according to their agreement with us, and our contractors are obligated not to use the personal information for any purpose unrelated to the business purpose for which we engaged them.

American Collectors does not sell, and within the last 12 months has not sold, any of your personal information to third parties. We also do not “share,” and within the last 12 months have not “shared,” any of your personal information with third parties, as the term “share” is defined in the CCPA.

Where required by applicable law, California residents may opt out of the sale or sharing of their personal information.

Some browsers have a “do not track” feature that lets you tell websites that you do not want to have your online activities tracked. At this time, we do not specifically respond to browser “do not track” signals.

We may collect and use sensitive personal information where reasonably necessary to provide insurance products and services, process transactions, prevent fraud, maintain security, comply with applicable law, or for other purposes permitted under California law.

You have the right to request that we limit the use and disclosure of your sensitive personal information by submitting a verifiable request using the contact information in this notice. If you submit such a request, we may continue to use or disclose your sensitive personal information to:

  • Complete the transaction for which we collected your personal information, provide goods or services that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you;
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;
  • Use it in a short-term and transient manner, including, but not limited to, to facilitate non-personalized advertising shown as part of your current interaction with our services, but not including disclosure to third parties or use outside your current interaction with our services;
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us; or
  • Make any other uses of that information that are permitted by the CCPA and its implementing regulations.

Subject to applicable law, exceptions, and verification requirements, California residents may have the following rights:

Right to Know and Access

You have the right to request that we disclose to you the categories and specific elements of personal information we collected about you, including:

  • Categories of personal information collected;
  • Specific pieces of personal information collected;
  • Categories of sources from which personal information was collected;
  • Business or commercial purposes for collecting, using, selling, or sharing personal information;
  • Categories of third parties to whom personal information has been disclosed; and

You also have the right to receive a copy of the categories and specific elements of personal information we collected about you in the preceding 12 months and/or to request that we transmit your personal information to another entity. To the extent feasible, we will provide and/or transmit your information in a structured, commonly used, machine-readable format.

Right to Delete

You have the right, under certain circumstances, to request that we delete the personal information we collected about you. We may deny your deletion request if retaining your personal information is necessary for us or our vendors to:

  • Complete the transaction for which we collected your personal information, provide goods or services that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you;
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;
  • Debug products to identify and repair errors that impair existing intended functionality;
  • Exercise free speech, ensure the right of another consumer to exercise their right of free speech, or exercise another right provided for by law;
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et seq.);
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the achievement of such research, if you previously provided informed consent;
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us;
  • Comply with a legal obligation; or
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Right to Correct

You have the right to request that we correct any of your personal information that is inaccurate. We will correct any inaccurate personal information pursuant to your request to the extent possible using commercially reasonable efforts. We may deny your correction request if the personal information is accurate. We may also delete your personal information instead of correcting it to the extent such deletion would not negatively impact you.

Right to Opt Out of Sale or Sharing

Where applicable, you may direct us not to sell or share your personal information as those terms are defined by California law.

Right to Limit Use and Disclosure of Sensitive Personal Information

Where applicable, you may direct us to limit certain uses and disclosures of sensitive personal information, subject to the exceptions described in the “Sensitive Personal Information” section above.

Right to Non-Discrimination

We will not discriminate against you for exercising privacy rights provided by applicable California law. Should you choose to exercise any of your rights under the CCPA, we will not:

  • Deny you goods or services;
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
  • Provide you a different level or quality of goods or services; or
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, it may be a functional necessity for our websites and online services to have personal information about you in order to operate, and we may not be able to provide some or all of our websites and online services to you if you direct us to delete your personal information.

You can exercise these rights up to two different times every 12 months. To submit a request to know or access, delete, correct, limit, or exercise another applicable California privacy right, you may contact American Collectors Insurance, LLC using any of the following methods:

We may ask you to fill out a request form or provide additional information to verify your request. After we receive your verifiable request, we will confirm our receipt and provide to you, in writing and free of charge (unless your request is excessive, repetitive, or manifestly unfounded), the requested information for the 12-month period preceding your request. If you specifically request disclosure beyond that 12-month period, we will process your request with respect to personal information we have collected during the time period you specify, provided that (a) the earliest date to which your request may apply is January 1, 2022, and (b) processing your request does not require disproportionate effort. You can choose to have this information delivered to you by postal mail or electronically. We will try to respond to your verified request within 45 days of receipt, but if we require more time (up to another 45 days), we will inform you of the reason and extension period in writing. We are not required to comply with your request for information more than twice in a 12-month period. If applicable, our response will explain the reasons why we cannot comply with your request.

To protect your personal information, we may need to verify your identity before processing certain requests. The information requested for verification may vary depending on the nature of the request and the sensitivity of the information involved.

Information provided for verification will be used for verification and processing of the request as permitted by applicable law.

The CCPA only allows us to act on your request if we can verify your identity or your authority to make the request, so you will need to follow our instructions for identity verification. If we cannot verify your identity to the degree required by applicable law, we may be unable to fulfill all or part of your request.

You may designate an authorized agent to submit certain California privacy requests on your behalf.

We may require an authorized agent to provide proof that you gave the agent permission to act on your behalf. We may also require you to verify your identity directly with us or confirm that you authorized the agent to submit the request, except where otherwise provided by applicable law.

While we do not knowingly collect the personal information of individuals who are under the age of 18, if you are the parent or legal guardian of a minor who is under the age of 13 and you believe we have collected that minor’s personal information, you may submit a request to exercise these rights on behalf of your minor child.

We retain each category of your personal information for no longer than is reasonably necessary for one or more business purposes, subject to your right to request that we delete your personal information. Due to the nature of the services we provide, including the fact that we are subject to various laws and regulations governing the retention of business records, it is not possible to predict the precise length of time that we intend to retain each piece of your personal information. We comply with data retention obligations imposed upon us by law, and those laws, together with best practices in the insurance industry and our applicable insurance, legal, regulatory, tax, accounting, fraud-prevention, and contractual requirements, inform our records retention practices.

When we determine that it is no longer reasonably necessary to retain your personal information for one or more disclosed business purposes based on the above criteria, we will delete your personal information.

Federal law imposes special restrictions and obligations on commercial website operators who direct their operations toward, and collect and use information from, children under the age of 13. Consistent with those requirements, we do not authorize our websites and online services to be used by children under the age of 18, and certainly not by anyone under the age of 13. We do not knowingly collect personal information from minors under the age of 18, and we do not knowingly sell or share the personal information of consumers under 16 years of age.

Certain information that American Collectors collects and processes in connection with insurance products or services may be governed by federal or state insurance and financial privacy laws or otherwise exempt from some provisions of the CCPA.

Where another applicable privacy law governs particular information, American Collectors will handle that information in accordance with applicable law.

We may update this California Privacy Notice periodically to reflect changes to our information practices, technology, legal requirements, or business operations.

When we make changes, we will update the “Last Updated” date at the top of this notice.
